Colormania / CEP referral commission terms and conditions: By submitting the form below to enroll in CEP referral commission program, you acknowledge that you have read and are in full agreement with the following terms and conditions of the Color Exchange Program, hereinafter referred to as “CEP”. 1) NO EMPLOYER / EMPLOYEE STATUS – Enrolling or, participating in Colormania’s CEP program, receiving email acknowledgement of enrollment, receiving a unique, designated, Promotional Identification Code from Colormania, (hereinafter referred to as ‘Promo Code’) and/or soliciting customers in any manner, shape or form, for Colormania’s CEP program in no way constitutes an offer of employment, nor does it convey employer / employee status between Enrollee, and Colormania, LLC, nor any of its subsidiaries, or parent company. 2) CEP Enrollees may not represent themselves as employees, agents, spokespersons, or representatives of Colormania, LLC. 3) CEP Enrollees may not advertise the CEP program, at any time, via any advertising medium without prior written consent from Colormania, LLC.   4) CEP Enrollees may not publicly issue any statements in behalf of Colormania by any means, on any social network, any form of media, whether printed, electronic, or televised without prior written consent from Colormania. 5) CEP Enrollees agree to function as independent agents, with no fiduciary relationship, nor connection to Colormania, LLC. 6) CEP Enrollee hereby agrees to indemnify and hold harmless Colormania, LLC, and its subsidiaries, and/or parent company for any injuries, damages, or harm incurred, at any time, or by any means, by the Enrollee, while promoting the CEP Program, or while traveling to, or returning from any places or events for the purposes of promoting the CEP Program. 7) Colormania, LLC reserves the right to modify, or terminate the CEP program at its discretion. 8) The sole responsibility of CEP Enrollees shall be to accurately present information about the CEP program and/or to print and distribute at the Enrollees expense, “coupons” promoting CEP to potential customers. 9) REMUNERATION – For each customer who purchases a paint job from Colormania, and who redeems a unique ‘Promo Code’ at the time of purchase of the paint job, the duly registered Enrollee who has been assigned that particular ‘Promo Code’, shall be paid the sum of $300.00 within one week of completed sales. In case the purchase order is canceled, or a refund or a chargeback; any paid commissions must be returned to Colormania by the Enrollee for that particular referral/ purchase. 10) Enrolling in Colormania’s CEP Program shall in no way guarantee payment of any fees, commissions, or funds. A completed sale using a CEP Enrollee’s ‘Promo Code’ is required before any payments can be tendered to any CEP Enrollee. 11) INCOME TAX REPORTING – CEP Enrollees who receive more than $599.00 will receive a Form 1099R. All earnings in excess of reportable amounts will be listed on the 1099R and duly reported to the appropriate taxing authority. Compliance with tax laws is required before any commissions are paid above $599.00 limit. 12) CEP Enrollees are solely responsible for any and/or income tax payments to the appropriate state and/or federal agencies for their place of residence. 13) Colormania, LLC, its subsidiaries, and/or parent company, and CEP Enrollee covenant and agree to indemnify and save each other harmless from any liability, loss, damage or expense, including assessable legal fees, arising out of the negligent performance of their respective obligations under this agreement or by anyone for whom they are in law responsible. The parties hereto agree that they shall co-operate with each other in the defense of any such action, including providing each other with prompt notice of any such action and the provision of all material documentation. The parties further agree that they have a right to retain their own counsel to conduct a full defense of any such action.  14) Cancellation & Expiration of Promo Code – Colormania at its sole discretion, at any time before prior notice; my cancel any Promo Codes or end the CEP Promo Code commission program, but any Promo Codes which have been already submitted by buyers of Colormania products to Colormania, will be honored and any due commissions paid to the beneficiaries. 15) Promo Code may not be applied toward any paint sets/jobs that are already discounted or are on sale or are sold at wholesale price. Promo Code may not be combined with any other promotional offer or discount.
